Amber Alert Issued For CA Teen Impregnated By Father In Dead Baby Case: Police

Authorities on Sunday issued an Amber Alert for a 14-year-old girl who law enforcement believes recently gave birth to her father's baby, an infant found dead by a roadside in Monterey County last month.

The alert was issued for Diana Galvez Ortega and her father, 38-year-old Sergio Galvez Perez, authorities said.

“Sergio Galvez Perez is wanted for numerous felony violations involving Diana, in which she is the victim,” the Monterey County Sheriff’s Office said in a social media post Sunday.

“These allegations are extremely serious and are an important part of why locating Diana and ensuring her safety and well-being remain a priority.”

Galvez Ortega is about 4 feet, 10 inches tall; weighs 100 pounds; and has black hair and brown eyes, authorities said. Galvez Perez is around 5 feet, 5 inches tall and 170 pounds, with black hair and brown eyes, according to officials.

Video surveillance located by detectives showed them in the Salinas area in a white Nissan Altima with no license plates, the sheriff’s office said. They were last seen at Constitution Boulevard and East Laurel Drive in Salinas, according to California Highway Patrol.

The Amber Alert is issued for Monterey, San Luis Obispo, Santa Barbara, Ventura, Kern, Los Angeles, San Bernardino, Riverside, San Diego, Orange and Imperial counties, according to the patrol.

Case Background

The newborn, whom investigators are calling “Baby Angelita,” was found dead along Struve Road on Aug. 1, according to the sheriff’s office.

Detectives determined during their investigation that a teen girl had given birth to Baby Angelita on the side of the road, and that the infant was left on the ground, according to the sheriff’s office.

A post-mortem forensic examination found signs of traumatic injury and that the baby still had her umbilical cord attached, officials said.

Police issued warrants Monday for the girl and her father.

The sheriff's office early last week said that the 14-year-old girl was wanted on suspicion of murder and that Galvez Perez faced warrants stating incest, lewd or lascivious acts with a child under 14, lewd acts with a minor, unlawful sexual intercourse, child concealment and child endangerment.

But on Wednesday, Monterey County District Attorney Jeannine Pacioni sent out a statement clarifying the matter of criminal charges for the 14-year-old, explaining that her office had not received a filing request for such charges against the girl, nor had the office received any investigative reports from law enforcement.

"As a result, our office has not made any charging decision regarding the 14-year-old Jane Doe," the district attorney's office announced.

Pacioni said there are charges against Galvez Perez for sexually assaulting his own daughter.

The sheriff's office's initial press release on the case, which discussed charging the 14-year-old, prompted community backlash from county leaders, who said the girl should be considered a victim.

Anyone who sees Galvez Perez, Galvez Ortega or a white Nissan Altima with no license plates should not approach, but should instead call 911 immediately, according to authorities.
