Man Convicted Of Murder In Girlfriend's Fatal Shooting In SMC: DA
The victim had called 911 hours before her death to report that her boyfriend had threatened her with a gun, prosecutors said.
SAN MATEO COUNTY, CA — A 44 year-old-man has been convicted of first-degree murder for the fatal shooting of his girlfriend, the San Mateo County District Attorney’s office announced Friday.
At around 7 a.m. on September 2, 2023, police said they responded to a 911 call and found 49-year-old Grace Marie Kelly dead in the garage of her home. Prosecutors said she had been shot at least twice by her boyfriend, Aubrey Avery Jr..
Family members who were in the home at the time reported that Avery and Kelly had argued and then gone downstairs to the garage, prosecutors said.

Following the shooting, police said they tracked the suspect down about a half mile from the home. Police said they recovered the firearm used in the killing at the time of his arrest.

Prosecutors previously revealed that just six hours before her death, Kelly had called 911 to report that her boyfriend had threatened her with a gun. However, when police arrived at the scene for that initial call, both Kelly and Avery denied the presence of a weapon.
