DARIEN, IL – A man got an order of drinks last month at a Darien restaurant's drive-thru, but they were delivered at an angle, spilling all over him, police said.

That led to a fight. Two men were charged.

Late at night on June 10, a 22-year-old Darien man who lives in the 1400 block of Sequoia Lane and his girlfriend went through the drive-thru at Culver's restaurant, 541 Plainfield Ave.

After the spill, the man entered Culver's to get napkins to clean up the mess.

Then he returned to clean his shirt in the restroom.

While in Culver's, the man admitted using vulgar language against employees, saying he probably shouldn't have done so, according to the report.

By his account, employees surrounded him and a fight ensued, in which he grabbed and pushed the workers, police said. One of the employees, a 20-year-old Chicago man, was accused of striking him on the neck, leaving a red mark, police said.

The 22-year-old customer stated that he had been frustrated because no one helped him clean the mess or seemed to care about the spilled drinks, police said.

The manager told police that he saw the 22-year-old man enter the restaurant and call employees vulgar names, according to the report. The manager said he followed the man outside to discuss the accident.

After coming inside, the manager reported he then heard a commotion, with employees asking the 22-year-old to leave.

The man then got into an altercation with a female employee, police said. Others pushed him back, causing him to trip and fall, police said.

Surveillance footage showed the fall and the 20-year-old employee's striking of the customer's neck, police said.

The employee said he hit the customer to defend the female employee, who was his mother. He also said he believed the 22-year-old had been drunk, which caused the situation to escalate, the report said.

The 20-year-old and 22-year-old were both cited on charges of battery and disorderly conduct, police said.

The customer was given a no-trespassing notice for the restaurant.
