According to the complaint, the agent encountered Daly driving alone in Stewartstown, near the Canadian border, shortly before midnight Saturday. During their conversation, the agent asked Daly whether he had used any other names. Daly then drove away.

The agent followed Daly as he drove approximately 10 miles to the Pittsburg Port of Entry on the U.S.-Canada border. By that time, it was past midnight, the crossing was closed and the gate was locked.

According to the complaint, the agent activated the emergency lights on his cruiser and exited the vehicle. Daly began to turn and then fired a handgun at the agent. The agent returned fire, striking Daly and wounding him.
