Zoning Board Rules T&C Corner Deli a Restaurant

The Zoning Board of Adjustment passed a resolution suggesting that T&C Corner Deli go back to the Planning Board and ask for any variance required as a restaurant.

came before the Zoning Board looking for an interpretation of the city's Development Regulations Ordinance as to the definitions of a restaurant and a retail sales establishment. The deli, 1 Ashwood Avenue, will now need to apply to the Planning Board for variances connected to the addition of seating.

"In the absence of a definition of deli or the term 'other eating establishment,' the Board could only render an opinion on the  definition of restaurant from the ordinance but found it to be ambiguous," Dennis Galvin, counsel and secretary to the Zoning Board of Adjustment. "So in addition to sending the applicant back to the planning board, the Board is recommending that the governing body review the definition of Restaurant and consider amending it to make it more clear."

The Planning Board would hear any variance requests associated with the addition of seating at the T&C Corner Deli because a restaurant use is permitted in the zone.

No date has been set for the hearing. The Planning Board's next meeting however is set for February 28.
