106 MPH Crash Injured Pregnant Woman, Killed Unborn Child; Amityville Man Indicted: DA

Prosecutors say the Amityville man, a correction officer, blew through two stop signs and crashed head-on into another vehicle.

NORTH AMITYVILLE, NY — A state correction officer has been indicted after prosecutors say he drove more than 100 mph through a residential area in Amityville before crashing head-on into another car, seriously injuring two people and killing an unborn child.

Andre-Marcel Devieux, 28, of Amityville, was indicted on multiple charges, including two counts of second-degree Assault, in connection with the Dec. 28, 2025, crash, Suffolk County District Attorney Ray Tierney said.

Prosecutors say Devieux was driving with a suspended license at the time of the crash.

According to investigators, the crash happened at around 8:34 p.m. on Dec. 28 as Devieux drove a 2020 Jeep Grand Cherokee SRT northeast on Parkway Avenue in Amityville.

Prosecutors said Devieux was traveling about 106 mph on the residential roadway when the crash occurred.

Prosecutors said as Parkway Avenue merges into Schleigel Boulevard, Devieux blew through two stop signs at a high rate of speed, crossed onto the wrong side of the road, and slammed head-on into a 2016 Volkswagen Jetta traveling in the opposite direction.

The two people inside the Jetta suffered serious physical injuries and were transported from the scene for treatment.

The driver sustained multiple traumatic injuries, including fractures to his leg, femur, ribs, spine, and eye socket that required inpatient rehabilitation, prosecutors said.

The front-seat passenger, who was seven months pregnant, was taken to Good Samaritan Hospital, where doctors attempted to save the baby but were unsuccessful.

The woman also suffered fractures to her ribs and sternum, authorities said.

Devieux was arraigned on March 13 before Acting Supreme Court Justice Anthony S. Senft Jr. on the charges contained in the indictment.

The charges include two counts of second-degree assault, second-degree reckless endangerment, reckless driving, and third-degree aggravated unlicensed operation of a motor vehicle, as well as multiple traffic infractions.

Justice Senft ordered Devieux held on $20,000 cash bail, $40,000 bond, or a $200,000 partially secured bond during the pendency of the case.

If convicted of the top count, Devieux faces up to seven years in prison, prosecutors said.

Devieux is being represented by Joseph LoPiccolo, who did immediately respond to a request for comment.

According to the DA’s office, New York law defines a homicide victim as “a human being who has been born and is alive,” meaning an unborn fetus cannot be the subject of a homicide charge.

“This crash changed lives in an instant,” Tierney said. “The survivors here were left with devastating injuries, including a young woman who was pregnant and looking forward to welcoming a new life into the world. Unfortunately, under New York law, no charges can be brought for the death of an unborn child. Nothing is more important to me than pursuing accountability and seeking justice for these victims.”

Devieux is scheduled to return to court on April 14.
