Commack Cemetery April rigged election & Non Compliance Lot Owners Meeting June 13th 2026. John E. Donegan, Jr., a lot owner, plans to pursue legal action against each Commack Cemetery Board Member. In April 2025, Commack Cemetery allegedly conducted a rigged lot owners meeting by including Marybeth Heberer Medolla, a non-lot owner and daughter of former superintendent William Heberer, as a candidate. The Commack Board was previously exposed for designating Marybeth Heberer Medolla as a trustee on a 2024 IRS 990 form. Additional information reveals alleged misappropriation of public funds totaling $15,000.00, given to William Heberer as emeritus. Notable witnesses include Suffolk County Comptroller John Kennedy, 12th District Leslie Kennedy, and NYS Division of Cemetery investigator Kerry McGovern. A non-compliance lot owners meeting is scheduled for June 13, 2026, at 10 am. John E. Donegan, Jr., represented by lawyer Frank Scagluso, has put the Commack Cemetery on notice. As the legal trustee, John E. Donegan, Jr. has filed a complaint with the NYS Division of Cemetery to declare the lot owners meeting null and void, and to inform that the election may expose lot owners to individual lawsuits, advising the Commack Cemetery to govern themselves accordingly.
