NoVA Man Helped Run Child Exploitation Network: FBI

ALEXANDRIA, VA — An Annandale man already facing dozens of state child pornography charges has now been arrested on a federal charge after prosecutors said he helped administer an encrypted online network dedicated to distributing child sexual abuse material.

Omar Garcia Bustamante, 32, made his initial appearance Wednesday in U.S. District Court in Alexandria on a criminal complaint charging him with engaging in a child exploitation enterprise, a federal offense that prosecutors allege involved distributing and receiving child sexual abuse material in concert with at least three other people.

According to court records, a magistrate judge granted the government's request to detain Bustamante pending further proceedings. His detention and preliminary hearing is scheduled for Friday afternoon in federal court.

Federal prosecutors allege the offense occurred between at least Jan. 28 and April 21, and involved an encrypted SimpleX Chat group in which members allegedly coordinated the sharing of child sexual abuse material.

Investigation Began With Dropbox CyberTip

According to an FBI affidavit filed in support of the criminal complaint, the investigation began in February when Dropbox submitted a CyberTip to the National Center for Missing and Exploited Children after detecting suspected child sexual abuse material uploaded to an account allegedly belonging to Bustamante.

Investigators traced the account to an internet connection at a residence on Justine Drive in Annandale. Fairfax County police later obtained search warrants for the Dropbox account and the residence after investigators said they identified additional suspected child sexual abuse material beyond what was initially reported in the CyberTip.

Fairfax County detectives executed a search warrant at Bustamante's home on April 22. During an interview conducted while the search warrant was being served, investigators said Bustamante admitted using the email account associated with the Dropbox account and acknowledged previously using the cloud storage service. According to the affidavit, he also admitted obtaining child sexual abuse material through Telegram groups and saving links to that material in his Dropbox account. Investigators further allege he admitted distributing child sexual abuse material to other Telegram users.

The affidavit states Fairfax County police initially arrested Bustamante on state child pornography charges before referring the investigation to the FBI in June.

FBI Alleges Defendant Helped Administer Encrypted Group

After reviewing Bustamante's seized iPhone and other electronic evidence under a federal search warrant, FBI investigators allege they discovered evidence linking him to a private group on the encrypted messaging platform SimpleX Chat.

According to the affidavit, investigators identified Bustamante as one of six administrators of a group chat with approximately 50 participants. Prosecutors allege the administrators encouraged members to recruit others, share child sexual abuse material and actively participate in the group. The affidavit alleges Bustamante both distributed child sexual abuse material and participated in conversations promoting the abuse of children.

The FBI alleges the group exchanged child sexual abuse material over multiple weeks involving numerous victims and that Bustamante repeatedly uploaded files and commented on material posted by other users. Investigators say evidence recovered from his phone also included additional child sexual abuse material stored in Telegram.

Federal agents allege the evidence establishes probable cause that Bustamante knowingly participated in a child exploitation enterprise by committing multiple federal child exploitation offenses with at least three other people.

State Charges Dropped After Federal Case Filed

Before the federal complaint was filed, Fairfax County had charged Bustamante with numerous felony counts related to the alleged possession and distribution of child pornography. Court records show one of those cases was dismissed through a nolle prosequi on July 28, a common procedural step when a case is transferred for federal prosecution.

Virginia court records show Bustamante had been charged in more than 30 Fairfax County felony cases alleging violations of Virginia's child pornography statute.

A criminal complaint contains allegations only. Bustamante has not been convicted of the federal charge, and the allegations will have to be proven in court.
