San Jose Man Sentenced In Road Rage Insurance Fraud Case

Police said Ken Pham Tran repeatedly brake-checked a truck then lied to insurance about his role in the resulting crash.

SAN JOSE, CA — A San Jose man was sentenced to 60 days in county jail after a jury convicted him of insurance fraud for filing a false claim following a road rage crash that he caused, prosecutors said Friday.

Ken Pham Tran, 53, was convicted last month of felony insurance fraud, felony vandalism and reckless driving.

Prosecutors said Tran repeatedly slammed on his brakes in front of a semi-truck on U.S. Highway 101 on Jan. 28, 2025, after believing the truck had cut him off. On the third "brake check," the truck driver was unable to stop and rear-ended Tran's Jeep Wrangler.

Authorities said Tran falsely told police and Progressive Insurance that he had been stopped in traffic when the truck struck his vehicle, omitting his own reckless driving.

The incident was captured on the truck's dashboard camera, and an independent witness called 911 to report Tran's driving before the collision.

As part of his sentence, Tran was ordered to pay $1,200 in restitution to Progressive Insurance and $3,001 to Bill Jacobsen Trucking.
