Should You Give Your Home to Your Children While You’re Still Living?

For many homeowners, a house represents decades of hard work, family memories, and financial security. Naturally, the question eventually comes up: What is the best way to pass it along to the next generation?

The idea of “giving while living” has understandable appeal. You get to watch your children or grandchildren benefit from your generosity, perhaps when help would make the greatest difference.

But as a Sarasota-area Realtor, I believe a decision this significant deserves more than a quick deed transfer. Before handing over your home, consider what that gift could mean for your future, your family, and the property itself.

Start With the Life You Want

Before discussing paperwork, I would start with a simple question: What are you hoping to accomplish?

Perhaps you want to help an adult child establish roots. Maybe you are ready to downsize but would love to keep the family home in the family. Or perhaps you want to simplify things for your heirs.

Those goals may lead to different solutions.

There is also your own next chapter to consider. Where will you live? Will you need the equity for retirement, healthcare, or another home? How much flexibility do you want to preserve?

Generosity works best when it supports your loved ones while keeping your own needs firmly in view.

A Gift Can Carry an Unexpected Tax Consequence

One important distinction is how a home’s tax basis is treated. Basis is generally the starting point used to calculate a taxable gain when property is sold.

For appreciated property given during your lifetime, the recipient generally takes your adjusted basis for determining gain. Inherited property generally receives a basis tied to its fair market value at death, subject to exceptions. That difference can substantially affect a future sale.

Imagine a home with an adjusted basis of $200,000 that is now worth $600,000. Giving it away does not automatically give the recipient a $600,000 basis.

This simplified example illustrates why a CPA should compare the consequences of gifting now with transferring the property later. The most heartfelt choice still deserves a careful look at the numbers.

Understand What Gift Reporting Means

Another common misunderstanding is that giving someone a valuable property automatically means an immediate tax bill.

A home transfer may require the person making the gift to file a federal gift tax return. Whether tax is actually payable depends on the applicable exclusions, available lifetime exemption, and previous gifts. Filing and paying are separate questions.

Selling a home to a child for a token amount is not necessarily a shortcut, either. A transfer for less than full value can still involve a gift for federal tax purposes.

Have your tax professional evaluate the proposed transaction before documents are signed.

Florida Homeowners Need to Check Property Taxes

Here in Florida, the current property tax bill does not necessarily tell the next owner what they will pay.

A qualifying change in ownership can trigger reassessment and the loss of accumulated Save Our Homes benefits. Certain transfers are exceptions, which makes the exact ownership arrangement important.

Before transferring a Sarasota or Manatee County home, ask the appropriate property appraiser’s office how the proposed change would affect the assessment and exemptions.

That conversation belongs alongside a realistic review of insurance, maintenance, association fees, and anticipated repairs. A mortgage-free home still comes with ongoing expenses.

Make Sure the Gift Fits Your Family

A home can be a wonderful gift, but it also creates responsibilities.

Does your child actually want to live there? Can they comfortably afford its upkeep? If several children will share ownership, who decides whether to sell, renovate, or rent it?

And if you intend to continue living in the property, how will your occupancy and responsibilities be protected?

These conversations may feel uncomfortable, but clarity now can prevent confusion later. I would encourage families to discuss expectations openly and have an attorney document the arrangement appropriately.

A loving intention deserves a workable plan.

Consider the Alternatives Before Choosing

Giving away the entire property is only one possibility.

Depending on your goals, it may be worth comparing an outright gift with selling and sharing some proceeds, helping with a down payment, or retaining ownership under an attorney-designed estate plan.

My role is to help you understand the real estate side, market value, selling options, housing choices, and practical ownership costs. Your attorney and tax adviser can evaluate the legal and financial structure.
