Arrested At Home Cut Donuts By Joliet Police: Andrew Planeta Seeks Prison Sentence Modification From Judge

Andrew Planeta was convicted of aggravated DUI in connection with a drive-by shooting he performed targeting a Joliet woman he knew.

JOLIET, IL — After spending all of this year locked away from society at Sheridan Correctional Center more than 30 miles away, Joliet's Andrew Planeta has lost his motion seeking to have his prison sentence reduced, records from his Will County Courthouse files show.

On Dec. 15, Planeta pleaded guilty in Will County to aggravated DUI and unlawful use of a weapon by a felon. He received four-year prison terms for each crime, but Will County Judge Vincent Cornelius allowed him to serve both sentences at the same time rather than one after the other. He was also ordered to serve his time at 50 percent.

The sentencing order indicated that Planeta was given 90 days credit for time already served in the Will County jail.

Then, last month, Planeta submitted a motion from Sheridan asking Judge Cornelius to modify his prison sentence to allow Planeta to get out of the DOC a bit earlier.

"Volunteer work as a kitchen worker. I worked in the kitchen a total of 12 days from December 1st to December 15th at the Will County ADF in 2025," Planeta's motion argued.

Planeta wrote that he should be credited with another 6 days of good time credit toward his remaining four-year prison sentence at Sheridan.

In the end, Judge Cornelius denied Planeta's motion seeking to gain more time credit toward his sentence.

According to the Illinois Department of Corrections website, Planeta is listed as being up for parole on March 29, 2027.

According to the DOC, Planeta has an interesting set of tattoos across his body. On his right leg, he has a tattoo of a naked woman; on his chest, he has "praying hands" and his right forearm has a cross and the name "Jesus."

Why did Planeta go to prison in the first place?

Last year, Joliet Patch produced multiple crime stories about Planeta's arrest by Joliet police.

According to his criminal complaint, Planeta recklessly discharged his gun on Sept. 16 while traveling from the 100 block of Joliet's Margaret Street to the Home Cut Donuts at 815 W. Jefferson St. That day, Joliet police responded to Margaret Street after learning that Planeta fired a gunshot from his truck.

The officers found one shell casing in the street. In the neighborhood, the officers spoke to Planeta's ex-girlfriend and her cousin, who told Joliet police they were inside when they heard the sound of a gun being shot.

According to court documents, both women only heard one gunshot and one of the women saw Planeta's truck, the 2023 Chevrolet Silverado, driving off, going south on Margaret before turning on Morris Street.

A short time later, prosecutors say another Joliet officer found the Chevy Silverado at the Home Cut Donuts, with the engine still running, and the windows down. The officer saw a black handgun on the front passenger seat, according to police. Planeta was arrested inside the Home Cut Donuts and brought to the Joliet police station for his booking.

Planeta was already a convicted felon and his driver's license was suspended in August 2024 for a DUI in Kane County. His license was later revoked in May of 2025. Planeta had previous DUI convictions in Will County from December 2011 and a DUI in DuPage County from 2006. His other previous convictions included illegal possession of a gun by a felon in 1995 and aggravated discharge of a gun, also from 1995.

As for the black semi-automatic Glock 23 handgun found inside Planeta's truck at Home Cut Donuts, Joliet police learned from Warrenville's Police Department that Planeta's gun was stolen from Warrenville on Nov. 28, 2024, court documents reflect.
