2023 Sexual Assault On Cape Cod Leads To Conviction Of 73-Year-Old Man

The Concord man was accused of assaulting a 20-year-old woman in a restaurant hallway, and was found guilty on Friday.

BARNSTABLE, MA — A Barnstable Superior Court jury on Friday found Elie Jammal, 73, of Concord, guilty on all charges related to the July 2023 sexual assault of a 20-year-old woman at a Sandwich restaurant.

According to a statement from Cape and Islands District Attorney Robert J. Galiboise, the victim was dining with family when she left the table to use the restroom. In a nearby hallway, Jammal – a stranger to the victim – commented on her appearance before pushing her against a wall.

He then sexually assaulted her and demanded she enter her phone number on his cellphone, prosecutors said.

The victim escaped into the restroom, but Jammal followed her inside and assaulted her again. After he left, the victim used her smartwatch to call for help. She was found distraught and hiding in a bathroom stall.

Outside the restaurant, the victim’s mother and a family friend confronted Jammal, who claimed the victim had initiated contact with him, according to Galiboise.

Police responded, though Jammal had driven from the scene before officers arrived.

A Barnstable County grand jury indicted him in November 2023 on charges of rape and two counts of indecent assault and battery on a person over 14.

Following the guilty verdicts, the court sentenced Jammal to 13 1/2 to 15 years in state prison on the rape conviction, followed by five years of probation on the indecent assault and battery conviction.

Galibois praised the victim for her “strength and courage” throughout the investigation and trial process.
