Herndon Man In Fairfax, Loudoun Cases Faces Federal Reentry Charge

FAIRFAX COUNTY, VA — Federal officers arrested a Herndon man Wednesday who is accused of returning to the United States without authorization after being removed twice, according to federal court records.

Jose Douglas Maldonado Regalado was arrested Aug. 26 on a federal charge of illegal reentry after removal. A magistrate judge ordered him temporarily detained in the custody of the U.S. Marshals Service pending a detention and preliminary hearing scheduled for 2 p.m. Monday, in federal court in Alexandria.

The federal case followed Maldonado Regalado’s May 8 arrest by Herndon police. Immigration and Customs Enforcement learned of that arrest and used his fingerprints to identify him, according to an affidavit filed by an ICE deportation officer.

Fingerprints Linked Arrest To Prior Removals

The affidavit identifies Maldonado Regalado as a native and citizen of Honduras who was removed from the United States near Alexandria, Louisiana, on Nov. 4, 2011, and again on Oct. 14, 2024.

Federal investigators obtained the fingerprint card and booking photo from the May arrest. The fingerprints matched immigration records associated with Maldonado Regalado, according to the affidavit.

ICE’s Homeland Security Investigations Forensic Laboratory separately compared fingerprints taken during Maldonado Regalado’s October 2024 removal with those collected by Herndon police in May. The laboratory reported Aug. 13 that the fingerprints matched, the affidavit said.

Investigators found no record that Maldonado Regalado had received permission from the U.S. attorney general or Department of Homeland Security secretary to reenter the country after his removal, according to the affidavit.

U.S. Magistrate Judge Ivan D. Davis signed the federal criminal complaint and arrest warrant Aug. 20. Maldonado Regalado appeared before Magistrate Judge Lindsey R. Vaala on Wednesday and was informed of the charge and potential penalties.

The court appointed federal public defender Whitney E.C. Minter to represent him. The charge remains an allegation, and Maldonado Regalado is presumed innocent unless proven guilty.

Pending Fairfax County Cases

Virginia court records show the May arrest resulted in a charge of driving while intoxicated, second offense within five years. The offense occurred May 7, and Maldonado Regalado was arrested the following day, according to Fairfax County General District Court records.

That case remains pending, with an adjudicatory hearing scheduled for Sept. 30. A related misdemeanor failure-to-appear charge stemming from a missed June 10 hearing is scheduled for the same day.

Maldonado Regalado was arrested again July 16 and charged with falsely identifying himself to law enforcement, court records show. That charge is also scheduled for a Sept. 30 hearing.

Two Herndon ordinance cases arising from July 16 accuse him of public intoxication and urinating in public. Hearings in those cases are scheduled for Sept. 23.

Loudoun Charges Followed 2024 Arrest

Maldonado Regalado also faces five unresolved charges in Loudoun County stemming from an alleged Aug. 18, 2024, incident.

Those charges include possessing a firearm while being unlawfully present in the United States, possessing a firearm while possessing a Schedule I or II drug, possessing a Schedule I or II drug, driving while intoxicated and leaving the scene of a crash involving more than $500 in damage.

Court records show he was arrested Aug. 19, 2024. Preliminary hearings on the three felony charges and adjudicatory hearings on the DWI and hit-and-run charges are scheduled for Oct. 1 in Loudoun General District Court.

A felony failure-to-appear charge and an allegation that Maldonado Regalado violated pretrial release conditions were dropped through nolle prosequi orders Aug. 14. A nolle prosequi ends the current prosecution without an acquittal and generally allows prosecutors to bring the charge again.

The federal affidavit says Maldonado Regalado was removed from the United States in Louisiana on Oct. 14, 2024, less than two months after the Loudoun arrest.

The state records use several versions of Maldonado Regalado’s name, including Jose Maldonado Regalado, Jose D. Maldonado Regalado and Jose Dugla Maldonado Regalado. All list his date of birth as Dec. 8, although the year is concealed in the publicly available records. The federal complaint lists the same name variations as aliases, and the federal affidavit directly connects Maldonado Regalado to the May 8 Herndon arrest through fingerprint analysis.

Taken together, the matching birth date, names and case history indicate the Fairfax, Loudoun and federal records concern the same person.
