Ex-Kane County Prosecutor Sues State’s Attorney
Former prosecutor alleges he was dismissed after reporting backdating of criminal filings, according to reports.
KANE COUNTY, IL — A former Kane County prosecutor is suing the county and State’s Attorney Jamie Mosser, alleging he was fired after reporting a routine practice of “backdating” criminal complaint filings, which he believed undermined legal fairness and public safety.
The lawsuit claims the backdating involved deputy clerks stamping documents with the prior business day’s date, potentially affecting deadlines, jurisdiction, license revocation proceedings, summary suspension-related matters, incarceration-related proceedings and more, according to Shaw Local. Eric Walliser, the former Kane County prosecutor, was placed on leave and then terminated shortly after disclosing the issue internally, and the county’s office characterized his conduct as “fraud on the court.”
The suit seeks back pay, damages, and other relief, while Mosser’s office says it will vigorously defend the case, Shaw Local is reporting.
